The Principles of Pretrial Detention

The President of the National Conference of Prosecutors, Raphaël Balland, spoke on France Inter this Friday morning about the principles of pretrial detention. This comes as the police officer suspected of violence against Hedi in Marseille remains in custody.

Criteria for Pretrial Detention

According to Balland, there are strict criteria that must be met for pretrial detention to be justified. While risks of flight or recidivism are rarely applied to police officers under investigation, the risk of fraudulent collusion with other individuals involved in the acts can be a valid reason. This was one of the elements highlighted by the Court of Appeal in Aix-en-Provence in the case of the police officer in Marseille.

Support for Police Protest Movement

The protest movement among some police officers in France, triggered by their colleague being placed in pretrial detention, can be supported under certain conditions. Balland states that if the movement shows solidarity with police colleagues facing disrespectful or violent behavior on the ground, it is understandable and should be supported. However, if the movement suggests support for police officers who have not respected the principles of proportionality in the use of force, it is incomprehensible and unacceptable.

Government Contact with Hedi and Court Proceedings
